Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and EatScore ("the Service", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service, or the minimum age required to consent to processing of personal data in your country of residence. If you are below that age, do not create an account.

2. The Service

EatScore is an informational nutrition-scoring tool. It lets you track foods and meals and score them against rules you configure yourself or adopt from third-party advisors you trust. Scoring output is a numeric summary of nutrition data according to rules you choose. It is not personalised medical advice.

Not medical advice. EatScore does not replace a qualified medical professional. Nothing the Service displays should be interpreted as diagnosis, prescription, treatment, or a recommendation to start, stop, or change any diet, medication, or health behaviour. If you have a medical condition, are pregnant, breastfeeding, take medication, or plan a significant dietary change, consult a qualified healthcare professional. Never disregard professional advice because of something you read on the Service.

You retain all rights to the foods, meals, prescriptions, advisors, health profile, and other data you enter ("Your Content"). You grant us a limited, worldwide, non-exclusive licence to host, store, and process Your Content solely to operate the Service for you. This licence ends when you delete the data or your account.

Reference-food data, scoring formulas, and software provided by the Service are owned by us or our licensors. You receive only a personal, non-transferable licence to use them through the Service.

6. Emails we send

By registering, you agree to receive transactional emails necessary to operate your account (e.g. email verification, password reset, critical security notices). These cannot be disabled while your account is active. Any other category of email — including summaries, digests, or product news — is optional and requires separate opt-in inside your profile. Every non-transactional email contains a one-click unsubscribe link.

7. Availability

We provide the Service on a best-effort "as is" and "as available" basis. We do not guarantee uninterrupted availability, that the Service will be error-free, or that scoring output matches any specific nutritional target. We may modify or discontinue features, or suspend the Service for maintenance, with reasonable notice where feasible.

8. Suspension and termination

We may suspend or terminate your account without notice if we reasonably believe you have violated these Terms, engaged in abusive or fraudulent behaviour, or if required by law. You may close your account at any time. Sections that by their nature should survive (Sections 5, 9, 10, 11) continue after termination.

9. Limitation of liability

To the maximum extent permitted by applicable law, the Service is provided without warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes or limits liability where it is unlawful to do so — in particular, liability for gross negligence, wilful misconduct, death, or personal injury caused by our negligence, or liability that cannot be excluded under mandatory consumer-protection law in your jurisdiction.

Subject to the above, our aggregate liability arising out of or in connection with the Service over any 12-month period is limited to the greater of (a) the amounts you paid us for the Service in that period, or (b) EUR 100.

10. Governing law and disputes

These Terms are governed by the laws of the European Union and the laws of the Member State in which the operator is established, without prejudice to any mandatory consumer-protection rights you enjoy in your country of habitual residence. Disputes should first be addressed to support@eatscore.app. If unresolved, EU consumers may use the online dispute-resolution platform at ec.europa.eu/consumers/odr.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. If you do not agree to the change, stop using the Service and close your account before the effective date.
